Account Credit Terms & Conditions

I (We) certify that all information provided by me (us) to Scott Energy is correct and current. I (We) authorize Scott Energy to check my (our) credit records at any time you deem necessary. If Scott Energy extends credit a result of my (our) credit application, I (we) agree to pay all amounts due to Scott Energy in full based on Scott Energy’s Terms of Sale. 

1. Period of Agreement.  These Account Credit Terms & Conditions take effect on the date that Scott Energy accepts my (our) credit application and continue until terminated by either (a) me (us) in writing sent to Scott Energy, P.O. Box 1439, Gloucester, MA 01931; or (b) by Scott Energy in writing to me (us) at my (our) address on my (our) credit application.
2. Terms of Sale.   All balances owed are due and payable in full within 30 days of the invoice date. Scott Energy neither accepts nor is bound by any term or condition which I (we) may propose unless Scott Energy accepts those terms or conditions in writing.
3. Finance Charges.  Scott Energy will assess a finance charge on past due balances at lesser of (a) the rate of 1½% per month (18% A.P.R.), or (b) the maximum rate allowed by Massachusetts law.
4. Budget Accounts.  If I am (we are) enrolled in the Budget Plan, Scott Energy (a) will consider my (our) account past due if a budget payment is missed; and (b) may remove me (us) from the Budget Plan or suspend any and all privileges under the Budget Plan.  For all products and services purchased outside of the Budget Plan, on the Terms of Sale apply.
5. Returned Checks and ACH Drafts.  Scott Energy will charge me (us) a $35 fee each time a check or ACH draft is returned unpaid by the bank.
6. Maintenance of Credit.  Scott Energy will continue my (our) credit terms contingent upon me (us) keeping my (our) account in good standing.  If my (our) account becomes delinquent or my (our) financial status changes, then Scott Energy may change or withdraw credit terms and/or suspend fuel deliveries and service to me (us). If  Scott Energy notifies me (us) that I am (we are) in default, Scott Energy reserves the right to review my (our) credit scores through a credit bureau.
7. Collection Costs.   If Scott Energy engages any third party to collect any outstanding balance from me (us), I (we) will reimburse Scott Energy for all costs of collection, including without limitation, all attorney’s fees, court fees, and sheriff charges.
8. Privacy.   Scott Energy does not share customer’s personal information with any other entity. Scott Energy takes data and personal information security seriously and will make best efforts to ensure the security of my (our) personal information.
